| I have taken the liberty to add this section to clarify some laws about rights and privacy of the subject and the photographer. Rights of the subject: If you are in a public place, a photographer may take your photo, without permission. Your rights come into play when the photographer actually uses their photo of you. I, by law, have to have a signed release to post your photos on my web site or to sell them. However, I do not need a release form if the photos are used for editorial purposes (e.g. magazine, newspaper, radio station web site) If there is no ban on photography at a live music show, then I still have the right to photograph you or your band without permission. Record deal or not. Rights of the photographer: I can photograph anything or anyone in a public place. If I do not have to use extraordinary means (super telephoto lens) to obtain a photo of you and you are in a public place then you are free game, so to speak. I cannot post or sell one of my photos of you without written permission from you. If you do use any of my photos on your web site, CD or DVD cover, it is customary to give proper photo credit. Rights and uses of photos are always negotiable. |
